DENKAM WATER SUPPLY AGREEMENT

Official Water Service Connection Agreement

This Water Supply Agreement ("Agreement") is entered into between Denkam Water Solutions ("the Company") and the Customer whose details are provided in the application form ("the Customer").

1. DEFINITIONS

  • "Company" means Denkam Water Solutions, the water service provider.
  • "Customer" means the person or entity applying for water connection services.
  • "Premises" means the property where water services will be supplied.
  • "Meter" means the water measuring device installed by the Company.
  • "Connection" means the physical link between the Company's water main and the Customer's premises.

2. SCOPE OF SERVICES

The Company agrees to:

  1. Supply potable water to the Customer's premises through the installed connection
  2. Install and maintain the water meter at the point of connection
  3. Provide regular meter reading services
  4. Issue monthly bills based on water consumption
  5. Respond to service-related complaints and emergencies

3. CONNECTION REQUIREMENTS

3.1 Application Process

The Customer must:

  • Complete the official application form
  • Provide valid identification documents
  • Provide proof of property ownership or tenancy
  • Pay the applicable connection fees

3.2 Connection Fees

The Customer shall pay:

  • One-time connection fee as per current rate schedule
  • Meter deposit (refundable upon termination)
  • Any additional costs for extended pipe work if required

4. CUSTOMER OBLIGATIONS

The Customer agrees to:

  1. Pay all water bills by the due date indicated on the bill
  2. Allow Company representatives access to the meter for readings and maintenance
  3. Report any leaks, meter damage, or irregularities immediately
  4. Not tamper with, bypass, or damage the water meter or connection
  5. Not extend water supply to neighboring properties without authorization
  6. Maintain internal plumbing in good condition to prevent water wastage
  7. Use water for lawful purposes only

5. BILLING AND PAYMENT

5.1 Billing Cycle

  • Bills are generated monthly based on meter readings
  • The billing period runs from the 1st to the last day of each month
  • Bills are due within 15 days of generation

5.2 Tariff Structure

  • Standard monthly charge applies to all connections
  • Consumption charges are based on units used (per cubic meter)
  • Current rates are available at the Company office

5.3 Late Payment

  • Penalty charges apply to overdue accounts
  • Continued non-payment may result in service disconnection
  • Reconnection requires payment of arrears plus reconnection fee

6. SERVICE INTERRUPTIONS

The Company may interrupt water supply for:

  • Scheduled maintenance (with prior notice)
  • Emergency repairs
  • Non-payment of bills
  • Violation of this Agreement
  • Force majeure events

The Company shall not be liable for damages arising from service interruptions beyond its reasonable control.

7. DISCONNECTION AND RECONNECTION

  1. The Company may disconnect service after 30 days of non-payment following due notice
  2. Illegal reconnection is a criminal offense and will be reported to authorities
  3. Reconnection requires payment of all outstanding amounts plus reconnection fee
  4. The Customer may request voluntary disconnection with 14 days notice

8. METER READING AND DISPUTES

  • Meter readings are conducted monthly by authorized Company personnel
  • Customers may request a meter test if they dispute readings (testing fee applies)
  • If the meter is found faulty, the testing fee is refunded and bills adjusted
  • Disputes must be raised within 14 days of receiving the bill

9. TERMINATION

This Agreement may be terminated:

  • By the Customer with 14 days written notice
  • By the Company for material breach of this Agreement
  • Upon sale or transfer of the property (new owner must apply for new connection)

Upon termination, the Customer must pay all outstanding amounts. Meter deposit will be refunded after deducting any arrears.

10. LIABILITY

  • The Company's liability is limited to the cost of water supplied
  • The Company is not liable for damage to Customer's property from internal plumbing issues
  • The Customer is responsible for all water passing through the meter

11. AMENDMENTS

The Company reserves the right to amend this Agreement with 30 days notice to Customers. Continued use of services after the notice period constitutes acceptance of amendments.

12. GOVERNING LAW

This Agreement shall be governed by the laws of Kenya. Any disputes shall be subject to the jurisdiction of Kenyan courts.
